Judges, and the judiciary is supposed to be a non political entity that rules based on what the Constitution Law IS, not what they would like it to be. What happened to “Judicial Independence”? I guess they just don’t have the courage to actually perform their jobs correctly……or it could be university law schools are failing their students like the rest of the university programs, and just not telling them what the duties of a judge are, like Harvard, for instance. But if a lawyer isn’t trained for how the mind of a judge is supposed to work, how does he/she best serve their client?

She did not rule on the LAW. She ONLY ruled on her perception of what is needed to make the law work. It is easy to skirt around the issue by not addressing the constitutionality of the mandate. NONE of the three judges actually ruled based upon its merits, only their opinion of why the merit is needed. The conservatives actually did rule based upon the constitution. Another idea would be to file suit againtst the judicial system itself citing the numerous and obvious prejudicial and discriminatory rulings made without just reflection upon the rules of law or the Constitution. As with every ruling there is usually an opinion attached by each judge giving some sense of what directed their judgement. As such it would not be hard to prove bias.

This may actually be the only grounds on which it is not actually unconstitutional. The entire concept of Federal regulation of Health Care is unconstitutional, but I don’t see this law as respecting an establishment of religion, or prohibiting the free exercise thereof. Mandating insurance is not the same as requiring the use of medical services. Mandating the purchase of ANYTHING is unconstitutional, but that is not what this particular lawsuit is about.

The reason that the Obamanation has no respect for our Constitution nor follows any of the amendments as outlined by its framers is because the Obamanation is not a natural born citizen. He has no vested interest in the well-being of this country. According to Article 1, Section II, Clause 5 of the Constitution, anyone running for president of the US must be a Natural Born Citizen, which means both parents must be born in the US. He is not natural born by virtue of his father being born in Kenya. It is also dubious that the Obamanation himself was born in the US as he has sealed all documentation relating to his birth. Nobody hides anything as innocuous as a birth certificate and other documentation UNLESS he has something that he does not want anyone to see and learn about him. So, that is why he blatantly disregards the Constitution and tramples on all that it stands for. He is not a US citizen by birth or otherwise. He has no respect for our laws or the will of its citizens. His purpose is to usurp our sovereign nation and destroy it from the inside. He is the terrorist that we have been trying to protect ourselves from infiltrating this country at every entry point in the US. Conservativism is the preservation of tradition. The United States has a tradition of Liberty and State Sovereignty. Therefore, Conservatism could, and in the way I define it, does include these as fundamnetals. The Conservative movement had a flourishing in the 1950′s and 1960′s initialized or inspired by any number of events, but I look to Robert Taft and some of his predecessors in both Parties, as founders of the Conservative Movement as we know it, not Goldwater (nothing against him). Think 1910′s to 1940′s (or, if you wish, you could trace it back even further, but we have no need for any more tangents).

And about that whole 1776/1787 thing: I did admit to my anachronism.

I apologize for my lack of contextualization before, and I apologize for my lack thereof now, but Jefferson and Madison saw no need for explicit Nullification in the Constitution itself, as it would have been a SELF EVIDENT TRUTH that no UNCONSTITUTIONAL LAW should be enforced or obeyed by a state, even if other states were to cowardly or to greedy to also nullify.

Forgive me for not remembering this, but can not the temporary nullification of a law by a state, be then permanently upheld by a court?

The Supremacy Clause only applies to Constitutional Laws. Any law that, in good standing, can be shown to be in violation of other clauses (Such as the Commerce Clause, which I believe is at the root of this entire discussion, whether 1811 or 2011) in accordance with original intent, should be rejected by a state, and THAT should be upheld by the courts, the supposed interpreters of the Constitutuion.

4.The Resolutions were judged
‘Unconstitutional’ by FEDERAL Courts. Enough said.

5.And yet, human nature leads governments astray, always. That is why there will always be the need for nullification.

The trouble with going before any judge from the Supreme court down, is to imply that they have the right to judge the constitutionality of a law. The founding fathers never intended for a judge to decide on a law’s constitutionality. To do so, positions the Supreme court as an oligarchy or dictatorship, to rule and rein over the citizens of the United States without any recourse for redress. The people are the judges of the constitution and they do that through their elected officials who create the laws. The states role is to protect the citizens of each state against unconstitutional laws and mandates passed down from the Federal Government. If the people don’t like a law, they can petition congress to change it. If congress won’t change it, then the citizens vote them out and elect new ones who will. But to seek help from a Federal or Supreme court judge on the constitutionality of a law is like crawling to Caesar on our bellies asking for his mercy. We are not slaves nor are we pawns of any court or judge, but sovereign citizens of a State united in a union for the defense of basic human rights. The sooner we realize that, the sooner we can take back our basic freedoms by re-empowering the states to put down Washington and oligarchical judges.

Don: About two weeks ago a person signing in as “Jababba” questioned the same. He provided a link to a petition to remove obama from the office of the presidency due to the citizenship question. The link he gave [ “ petition-to-remove barack-obama-as-president-united-states-america/”]. I followed that link … it contains some minor flaws but I did get to the petition. I signed the petition and added a comment of my own referencing my concern for the Lt Col. Jailed for questioning the same. I of course had to provide by home address and phone number. I had no problem with that. Within minutes I received a response that my signing had been forwarded to both of my senators and my representative. Two days later I received a response from one of my senators stating that a birth certificate had been located and authenticated by an expert and that the Supreme Court had no need to give further consideration. I am not saying that I like or believe the response … I am just stating what happened. I would like to see what would happen if more people signed that petition. You know sometimes you just got to stand up for the things that are right. … Take care and God Bless.

  I was blogging many months ago and found a blog that gave a link to a website that had a birth certificate with Obama’s name his mother, father the doctor’s name and signature and it also had an actual seal on it as well. It certainly looked authentic and it showed he was in fact born in KENYA. The website turned out to be scribd.com…..I did go back in several days later and curiously could not find it again anywhere. i downloaded a copy of it the first time I was in there but the seal was not visible….that was a bummer.

I also contacted both Senators and my COngressman and was told the same thing. They agree that he is legal, and has papers to prove it. When I questioned them if they seem the papers of course there was no response. I am not sure what is going on here but something stinks. One other point. As I understood it, “WATSON” didn’t “hear” the questions. They were typed into the computer by humans.

Not that computers are not capable of “hearing” verbalizations, only that software to convert verbalizations into digital form are not really accurate enough to use for something like a quiz show. Particularly one with the nuances that are often found on Jeopardy.

I know I have used a number of these software programs and speak pretty clearly and yet they have all garbled up wording far too often to make them dependable for most data inputting that requires accuracy.

So can you imagine how badly garbled up the testimony would be from some of those you have heard speaking on Divorce Court or People’s Court? I shudder to think of what “Watson” would make of THAT sort of input!

If Congress passed a law requiring taxes of black people but not white people, would you agree that would be unconstitutional. Next question: Congress passed a law requiring taxes on tanning salons, which are only used by white people, as black people do not go to tanning salons to get a tan. But no one says it is unconstitutional to tax white people and not black people. Discrimination clearly applies only to white people, never to black people who are exempt from any charges of discrimination. Of course, from a sociology point of view, it is quite predictable a certain number of judges are going to deal out Third World-style justice-for-sale when the judiciary routinely ignores the law–you may not know the specific individuals involved, but you do know when judicial rulings become totally arbitrary, there have to be some magistrates out there putting up their influence for sale to the highest bidder. And even if direct bribery is not involved, when judicial rulings become a crapshoot depending on the state of the digestion of the jurist that day, litigants are going to pay a premium to slant the odds their way–hence, standard $200-per-hour fees for lawyers. And then the judges complain that taxpayers have to fork up bigger judicial salaries in order to compete with private practice for talent–the same chutzpah a health official would show if he had the nerve to complain his salary was too low, because his failure to enforce sanitary practices was giving rise to epidemics driving up the price of doctors! And whether a judge actually receives compensation to ignore what the law says concerning a case–that’s immaterial, corruption is corruption. When two masked intruders shoot up two banks, but only one actually leaves with loot, which is the lawbreaker? The answer, of course, is both are–it’s just that one was too stupid to at least get material compensation to make his illegal behavior worth his while. It doesn’t make him any more honest.

We have to stop evaluating judges on whether they’re liberal or conservative–political beliefs are immaterial. Judges are either honest, or they’re corrupt. They are despots, or they are liberals (in the genuine 18th Century sense of the term, not the oxymoronic meaning that leftists attached to the label in deceitfully adopting it). The only revelance political party has to judicial appointments is the million dollar question of why Democrats seem to think their own ideas are so defective that mustering a political consensus in favor of them is impossible, so that rigging the judicial process in their favor is there only hope of putting their ideas into effect.

Frankly, the first plank in the Tea Party’s
“Contract From America” is a joke unless Congress starts cracking down in earnest on judges that jettison the legislative intent of the authors of the Constitution and of the laws in favor of their own pet ideologies. If U.S. District Judge Gladys Kessler were a man, and if Thomas Jefferson and James Madison were still alive, I have little doubt that our founders would be pouring hot tar and feathers down Kessler’s back, or presenting a challenge to a duel, in response to Kessler making a mockery of the religious liberty ideals both founders worked to instill in the new nation. I (and I suspect a vast majority of Christians) would certainly never take the stance of refusing all medical services. However, Jefferson’s and Madison’s efforts at legislating religious liberty were mainly undertaken on behalf of low-church dissidents well out of the religious mainstream of that day, like Baptists and Quakers. Jefferson and Madison wanted to end persecution from the high-church religious establishment like the Anglican church in matters of conscience, a tradition of persecution that today’s religious establishment (the religion of so-called liberalism) seems all-too-eager to revive.

“She also said that anyone who objects to having health care for religious reasons can choose to pay the penalty instead — as the lawsuit said all five plaintiffs plan to do.” Oh really! Sounds too much like the federal court’s common practice of enriching the ACLU by awarding them court costs in creche-police cases. What it all amounts to is plain jizya, allowing a established religion to enrich itself by levying a tax on a rival religion, as visible proof of its subjection and inferior status to the former. Just the very thing Jefferson and Madison were trying to get rid of, in fighting the practice of taxing dissident denominations to support ministers who had earned university doctorates in the established church! (What makes Kessler’s contempt of liberty of conscience so infuriating is that the Obamacare law grants specific religious exemptions to Muslims, who seem to share a lot in common with their secular humanist cohorts in their regard for religious liberty).

“We welcome this ruling, which marks the third time a court has reviewed the Affordable Care Act on the merits and upheld it as constitutional,” said spokeswoman Tracy Schmaler. “This court found — as two others have previously — that the minimum coverage provision of the statute was a reasonable measure for Congress to take in reforming our health care system.”

If a majority of judges should end up ruling in support of Obamacare, that will not be a measure of the justice of its case. It will be a measure of how deeply our justice system has been infiltrated by crooked liars. and how desperately we need to replace them with honest jurists who will regard our Constitution as a mistress to submit to, rather than a call girl to bend to their own desires.

Our schools, and colleges have been full of communists, marxists, and socialists for years, they have educated our young to hate the capitolist world and accept socialists values since the 70′s. To begin with the passing of the Health Care Reform Bill was not ethical or legal. The congress and senate represent the American people not the president or Peloski. We have a deficit not one made by the American Public but one created by the same Government who wants to shut down. By shut down they mean the little people in this country not the government they are exempt. VA employees who are Administrative staff, they make all appointments and madke sure your taken care of, they will be let go until the “GOVERNAMENT REOPENS”. Same with US Military no advancement or pay raises. If the Government wants to shut down then Mrs. Obama should put on an apron and cook and clean in the white house, all senators and congressmen should not be paid, Government shut down so they are not working..Maybe it is time to rethink on how our government should really work. I am sure if these people can prove they have refused insurance in the past for religious reasons then they can get the exemption. Obama also reversed an earlier decision by his administration to open access to coastal waters for exploration, instead placing a seven-year ban on drilling in the Atlantic and Pacific Coasts and Eastern Gulf of Mexico as part of the government’s 2012-2017 Outer Continental Shelf Program.
The Obama Permitorium is Costing the Government Much-Needed Revenue: The Gulf accounts for more than 25 percent of domestic oil production. With production in the Gulf expected to drop in 2011 by 220,000 barrels per day, the Energy Information Administration (EIA) estimates the U.S. will suffer $3.7 million in lost revenue per day as a result of lost royalties. If that holds, the federal government would lose more than $1.35 billion from royalty payments, just this year.

Rather than make a decision based on sound, traditioanl legal principles then succumb to their personal political ideolgy. The commerce clause was never intended to be used to interfer in personal decision making of individuals, but was meant only to regulate commerce between the various states in order to prevent, for example, one state from imposing a tax on anothers goods being transported into or through it. The gross misinterpretation of the commerce clause by Kessler is a gross miscarriage of the law. Impeachment is the only answer to correct this mistake.
