The main responsibility of any judge is to rule on the Constitution and law and not on personal beliefs or agendas. Sadly, we have a judicial system that is rife with judges who have forgotten their main responsibility and use their position on the bench to push their personal political agendas.

One example was an incident that happened in 2012. Atheist Ernie Perce wore a zombie Muhammad costume to a Halloween event. Talaag Elbayomy, a Muslim, confronted Perce about his costume, told him it was offensive and then started to beat him. The attack was caught on video.

Elbayomy was arrested and charged with assault. At the trial, there was testimony presented by an officer who witnesses the attack along with the video. Judge Mark Martin, then dismissed the case against Elbayomy and lectured Perce about the sensitivities of the Muslim culture. In court, Martin told Perce,

“They are so immersed in it and what you’ve done is you’ve completely trashed their essence, their being. They find it very, very, very offensive. I’m a Muslim. I find it offensive.”

That’s right. Judge Martin, who served in Iraq, is a convert to Islam. His own personal Islamic beliefs definitely clouded his ability to interpret US and Pennsylvania law. His decision to throw out the case basically sends a message to all Muslims in Pennsylvania that they can physically attack anyone who offends their religion.

Another prime example are Supreme Court Justices Ruth Bader Ginsberg and Elena Kagan as explained by Dr. Steven Hotze:

“Steven F. Hotze, M.D., President of Conservative Republicans of Texas (CRT), filed a motion in the U.S. Supreme Court this week urging the recusal of Justices Ruth Bader Ginsburg and Elena Kagan in the marriage case, Obergefell v. Hodges.”

“Both Ginsburg and Kagan have performed homosexual marriage ceremonies. Justice Ginsburg has also made public statements indicating that she is in favor of homosexual marriage. This past Tuesday the Court heard oral arguments in the Obergefell case regarding the constitutionality of defining marriage as between one man and one woman.”

“The words and actions of Ginsburg and Kagan demonstrate that they cannot consider this case impartially, therefore the code of judicial ethics requires that they recuse themselves to prevent the appearance of bias.”

Neither justice recused themselves and to no surprise, they both ruled in favor of same-sex marriages.

As Judge Neil Gorsuch, who is a judge with the United States Court of Appeals for the Tenth Circuit, sat in the hot seat being hostilely interrogated by angry liberal Democrats, he calmly held his ground and tried to explain that he values that main responsibility of a judge to rule on law, not on personal agenda.

One of those Democratic Senators who viciously attacked Gorsuch was Sen. Chuck Schumer, the Senate Minority Leader from New York. Schumer continually tried to get Gorsuch to tell him how he would rule in a number of different cases and Gorsuch continued to say he would not say how he would rule other than he would rule on the law, not on his personal political views. This is precisely what a judge is supposed to do.

However, Schumer refused to accept that fact and then demonstrated his ignorance when he spoke to the media after Tuesday’s hearing. Schumer stated:

“Judge Gorsuch may act like a neutral, calm judge, but his record and his career clearly show he harbors a right wing, pro-corporate, special interest agenda.”

“He enacted it time and time again on the 10th Circuit, and if given the chance I have no doubt he would do it again on the Supreme Court. He expresses a lot of empathy and sympathy for the less powerful, but when it comes time to rule, when the chips are down, far too often he sides with the powerful few over everyday Americans just trying to get a fair shake.”

A recent poll shows that 49% of likely voters believe the opposition to the nomination of Neil Gorsuch is due to partisan politics and has nothing to do with Gorsuch’s views. The same poll, taken after the first two days of confirmation hearings shows that 82% of likely voters believe that Gorsuch will be confirmed to be the newest addition to the United States Supreme Court.

Even the highly liberal left-wing media outlet CNN says that Schumer was dead wrong to criticize Gorsuch the way he did. They went to explain why they so charged Schumer with being wrong.

The fact is, Democrats like Schumer are not used to judges who actually rule on the law. Schumer was in the Senate and voted to approve Obama’s nomination of Elena Kagan and Sonia Sotomayor, both of which have demonstrated, before and after that they have very strong liberal and Democratic political views that have swayed their decisions. So, for Schumer to make the accusations he made against Judge Neil Gorsuch clearly demonstrates just how stupid and hypocritical Schumer really is and why he should not be in any political office, especially that of Senate Minority Leader.
